1. Acceptance of Terms

By accessing or using AI Doctor (the "Platform"), accessible at https://ai-doctor.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you ("User", "you") and AI Doctor ("we", "us", "our"), operated by Colbex SRL.

2. Nature of the Platform — NOT a Medical Service

AI Doctor is NOT a medical service and does NOT replace a doctor. The Platform provides AI-generated informational content based on user-reported symptoms and uploaded images. Specifically:

• The Platform does not provide medical diagnosis, medical advice, or medical treatment.
• The Platform does not replace consultation with a licensed physician, specialist, or other healthcare professional.
• All AI-generated responses are for informational and educational purposes only and serve as entertainment and preliminary guidance, not as medical opinion.
• The Platform does not create a doctor-patient relationship between you and AI Doctor, its operators, or any affiliated party.
• AI-generated analyses may be inaccurate, incomplete, or misleading. You should never make medical decisions based solely on Platform output.

3. No Reliance on AI-Generated Content

You acknowledge and agree that:

• You will not rely on AI-generated responses as a substitute for professional medical evaluation, diagnosis, or treatment.
• You will always consult a qualified healthcare provider before making any health-related decisions.
• The Platform's AI may access real-time internet search results to supplement its responses. However, such references do not constitute endorsement or validation of the cited sources.
• The Platform may produce incorrect or hallucinated information. You must use your own judgment and seek professional medical advice.

4. Emergency Warning

If you are experiencing a medical emergency, do NOT use this Platform. Call your local emergency number (e.g., 112 in the EU, 911 in the US) or go to the nearest emergency room immediately. The Platform is not designed, intended, or capable of handling emergency situations.

5. User Eligibility

You must be at least 18 years old to use this Platform. By registering, you confirm that you are of legal age and have the capacity to enter into these Terms. If you are under 18, you may only use the Platform with the involvement of a parent or legal guardian.

6. User Account and Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and truthful information about your symptoms and health conditions.
• Not using the Platform for self-diagnosis in lieu of seeing a healthcare professional.
• Not sharing your account with third parties.

7. Acceptable Use

You agree not to:

• Use the Platform to obtain medical advice for others without their consent.
• Upload images of other persons without their explicit permission.
• Use the Platform for any illegal, harmful, or fraudulent purpose.
• Attempt to reverse-engineer, hack, or disrupt the Platform's operations.
• Use AI-generated content for commercial purposes without our written consent.
• Upload content that is offensive, illegal, or violates intellectual property rights.

8. Credits and Payments

The Platform offers a free trial with a limited number of messages. Continued use requires the purchase of credit packages. Payment is processed through third-party providers (Stripe, PayPal, or bank transfer). By purchasing credits:

• You agree to the pricing terms displayed on the Pricing page.
• All payments are final and non-refundable unless required by applicable law.
• Credits have no cash value and expire if unused within 12 months of purchase.
• We reserve the right to modify pricing at any time with prior notice.

9. Intellectual Property

All content, features, and functionality of the Platform — including text, graphics, logos, icons, and software — are the exclusive property of AI Doctor / Colbex SRL and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Privacy and Data Processing

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and processing of your data as described therein. Health-related information you share is processed for the sole purpose of providing AI-generated informational responses.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of accuracy, reliability, or completeness of AI-generated content.
• Warranties that the Platform will be uninterrupted, secure, or error-free.
• Warranties of fitness for a particular purpose, including medical purposes.
• Warranties of non-infringement.

You use the Platform entirely at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, AI Doctor / Colbex SRL, its affiliates, officers, employees, and licensors shall not be liable for:

• Any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
• Any medical decisions made based on AI-generated content.
• Any harm, injury, or loss resulting from reliance on Platform output.
• Any unauthorized access to or alteration of your data.
• Any technical failures, outages, or service interruptions.

Your sole and exclusive remedy for any dispute with the Platform is to discontinue using the Platform.

13. Indemnification

You agree to indemnify and hold harmless AI Doctor / Colbex SRL, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform.
• Your violation of these Terms.
• Any medical decisions made based on Platform output.
• Your violation of any rights of another party.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, with registered office at Str. Izvorul Muresului, Nr. 8, Camera 1, Bl. A4, Sc. B, Et. 4, Ap. 30, Sector 4, Bucuresti (CIF: RO50325335, Reg. Com.: J40/13183/2024). Any disputes shall be resolved in the competent courts of Bucuresti, Romania, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting the updated Terms on this page. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

16. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause or notice. Upon termination, all credits and data associated with your account may be lost. You may terminate your account at any time by contacting us.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and AI Doctor regarding the use of the Platform.
